Agreement between User and Enlighten Counseling LLC.
Welcome to www.enlightenmedlIc.com. We look forward to providing medical cannabis counseling to you, (the "User"), of this website (the "Site"). This Site and its web pages are operated by Enlighten Counseling LLC ("EC"). It is important that we establish the terms and conditions of your use of the Site so that the User has a clear understanding of what to expect and how to utilize the services of EC. The use of this Site is offered to the User conditioned on the User's acceptance, without modification, of the terms, conditions, and notices contained herein (the "Terms"). Use of the Site confirms and constitutes the User's agreement to all such Terms. It is imperative that the User read these Terms carefully and keep a copy of them for future reference.
EC DOES NOT KNOWINGLY COLLECT, EITHER ONLINE OR OFFLINE, PERSONAL INFORMATION FROM PERSONS UNDER THE AGE OF THIRTEEN. ANY PERSONS UNDER THE AGE OF 18 MAY USE THE SITE ONLY WITH PERMISSION OF A PARENT OR GUARDIAN.
In order to use the medical cannabis services of EC, the User must communicate through electronic communications. The User agrees that any and all communications provided to the User will be done via electronic communications and on the Site. The User consents to receiving any and all communications electronically and use of the Site satisfies any legal requirement that such communications be in writing.
The User hereby agrees and warrants that the User will not use the Site for any purpose that is unlawful or prohibited by these Terms. The User agrees that it will not use the Site in any manner which would overburden or impair the Site or impair any other party's use and enjoyment of the Site. The User will not modify, publish, reverse engineer, participate in the transfer or sale or exploit any content of the Site in any fashion. All contents of the Site are the property of Enlighten Counseling LLC.
The Site may contain links to other websites ("Linked Sites") provided solely as a convenience. Any services made available through Linked Sites are not endorsed or the responsibility EC. EC does not control a linked Site is not responsible for any changes or updates to a linked Site.
The User warrants that the User will not use the Site for any unlawful purposes or for any purpose prohibited by these terms. The User may not use the Site or engage in any activity or conduct which would overburden, damage, or impair the Site or interfere with the use of another party's use of the Site.
All content of the Site, including but not limited to, texts, graphics, logos, images, and software is the property of EC or its suppliers. The User agrees to observe and abide by all copyright and other proprietorial notices or other restrictions contained in the content.
All materials and information made available to the User on the website are for the User only. The User may not obtain or attempt to obtain any information or materials to any means not made available or provided for by the Site.
The content of EC is not for resale. The User is not entitled to make any unauthorized use of any of the protected content without the express written consent of EC. EC does not grant any licenses, express or implied, to the intellectual property of EC or its licensors except as expressly authorized by these terms. The User shall not delete or alter any proprietorial rights or attribution notices and any contents. The User shall not modify, transmit, reverse engineer, publish, participate in the transfer or sale, create derivative works, or in any way exploit any of the content found on the Site.
The User agrees to indemnify, defend and hold harmless EC, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses, including legal fees, relating to or arising out of your use of or inability to use the Site or services. If the User violates the terms of this agreement or violates the rights of any third party or applicable laws, EC reserves the right, at its own cost, to assume the exclusive defense and control of any matter or otherwise subject to indemnification by the User in which the User will fully cooperate with EC in asserting any available defenses. In the event there is a dispute that is not resolved between the User and EC arising terms and conditions, or any provisions thereof, whether in contract, tort, or in equity for damages or any other relief, then such dispute shall be by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association in the State of New Jersey. If there is a termination of the terms and conditions, this arbitration provision shall survive.
The products, software, services, and information included in or available through the Site may include typographical errors and inaccuracies. In no event shall EC and/or any of its suppliers be liable for any direct, indirect, punitive, incidental, special, consequential damages or any damages whatsoever, including, without limitation, damages for loss of use, data, or profits, arising out of or in any way connected with the use or performance of the Site with the delay or inability to use the Site or related services. The provision of or failure to provide services, or any information, products, software, services, and related graphics obtained through the Site, or otherwise arising out of use of the Site, whether based on contract, tort, negligence, strict liability or otherwise, even if EC or any of its suppliers has been advised of the possibility of damages.
EC and/or its suppliers make no representations about the reliability, availability, timeliness, and accuracy of the information, products, software, and related graphics contained on the Site for any purpose. All such information is provided without warranty or condition of any kind. EC and its suppliers hereby disclaim all warranties and condition with regard to disinformation, software, products, software, services, and related graphics, including all implied warranties or conditions or merchant ability, fitness for a particular purpose, title and noninfringement.
Changes are periodically added to the Site and to the information contained herein. EC and/or its suppliers may make improvements and/or changes to the Site at any time. If you are dissatisfied with any portion of the Site, or terms of use, your sole and exclusive remedy is to discontinue using the Site.
EC reserves the right to terminate the User's access to the Site and the related services, or any portion thereof at any time, at its sole discretion, without notice. This constitutes the entire Agreement between the User and EC with respect to the Site.
EC reserves the right, in its sole discretion, to change the Terms under which www.enlightenmedllc.com is offered. The most current version of the Terms will supersede all previous versions. EC encourages you to periodically review the Terms to stay informed of our updates.
